Travis Tormey and Christopher Perry of the Tormey Law Firm LLC recently represented a client who had been charged with simple possession of marijuana (less than 50 grams) and possession of illegal fireworks in Mount Olive, New Jersey. Since the charges were classified as disorderly persons offenses (misdemeanors), the case was dealt with in the Mount Olive Municipal Court.
The charges resulted from an incident that occurred more than 25 years ago. It was 1990 and our client was just a young man. He and his friends were placed under arrest and charged with minor criminal offenses. However, our client was never able to resolve the charges in court because he moved from New Jersey to California. Our client eventually became a successful business man with a family. The NJ drug offense charges only became an issue for the client when he attempted to get a firearms license in California. That’s when he made the decision to hire the Tormey Law Firm and finally resolve these criminal charges.
Mr. Perry began his defense of the client by filing a motion to dismiss the charges due to the age of the case. Mr. Perry also highlighted the fact that the client had been a model citizen and did not have a criminal record, with the exception of these pending minor drug crime charges. Since the prosecution did not have much evidence to support the charges, the case was dropped. The client had to pay a small monetary fine for failing to appear in court 25 years ago, but his permanent record was now completely clear of criminal charges or convictions. As a result, he was finally able to obtain his firearms license in California. This was an extremely positive result for the client and a success story for the Tormey Law Firm.
