I recently represented a client who was charged with shoplifting in the Morris Plains Municipal Court. My client is a permanent resident present in the United States on a green card and could face deportation if convicted of this offense as shoplifting is considered a “crime of moral terpitude”. The amount of the alleged theft was $20.00. After the State failed to over any downgrade of the shoplifting offense, either to a municipal ordinance or another criminal violation such as disorderly conduct which would not lead to deportation, I filed a motion to have the case heard before the Assignment Judge at the Morris County Superior Court in Morristown, New Jersey.
After the motion, the Judge agreed to dismiss the charges after six (6) months if the defendant completed community service, provided proof of the civil penalty paid to the store ($180.00), and agreed never to return to the store. This was an extremely satisfying result for the client and our firm.
