My criminal defense trial team represents clients charged with driving while intoxicated (DWI) throughout New Jersey including in Dover, Denville, Parsippany, and Mount Olive. For a first offense driving while intoxicated violation in New Jersey, the penalties depend on the breath test readings involved. If the defendant’s blood alcohol content (BAC) is between .08% and .10%, this is known as a “first tier” DWI violation and results in a three (3) month license suspension. If the defendant’s BAC is over .10% and it is a first DWI offense in New Jersey, the license suspension ranges from seven (7) months to one (1) year. Further, if the defendant’s BAC is .15% or higher, there is a mandatory installation of an ignition interlock device on the defendant’s vehicle during the period of license suspension and for six (6) months after the license suspension is over.
