Our law firm recently won an appeal at the New Jersey Appellate Division in a drunk driving/refusal to submit to a breath test case. The Appellate Division held in State v. O”Driscoll that the failure to read the current “Standard Statement” form as opposed to an outdated “Standard Statement” form is grounds for a dismissal of a Refusal to Submit to a Breath Test charge in New Jersey.
